To better understand the differencebetween the Federal Appeals Court and the Supreme Court, we should first talkabout how each of them functions. The Federal appeals court has the power todecide on appeals against decisions of the district courts, to decide onappeals against the decisions of courts on basic criminal proceedings.
Speakingof the great strength that the Appeals Court has in the United States, it hasto be mentioned that the court legally covers millions of people. The AppealsCourt according to the United States federal court system is the last mediatoron the ladder for federal cases. On theother hand, we have the Supreme Court of United States. It is the most powerfulcourt in America. It has the final saying in all federal court cases. Eventhough the Supreme Court has the power to moderate cases with political notions,it does not have the power to affect political questions.
Thereason the courts have become so politicized is because in the supreme court thejudges are elected by the president and the senate. The president has the rightto elect anybody as a judge as long as the senate approves, meaning they will inmost cases elect people with similar world views and ideologies. That does notexclude the possibility of a judge making a different decision to what thepresident would think, as they gain all the right to act independently aftergetting elected. A wayto get the senate to stop the vote for a judge nominee is something calledfilibuster. It is a procedure in which the member of the senate who has theword, and does not want the nominee to be selected even though the majorityvote would have them succeed, so they just keep talking. The reasoning behindthis is that if they don’t stop talking and initiate the vote, after enoughtime members of the senate would give up and leave, meaning that the speakercan talk about barely connected topics, some irrelevant even, just to prolongthe time.
Recently a few political changes occurred and the filibuster forsupreme courts has been eliminated. Unlikethe supreme court, the Federal Appeals court has a different method of judgeselection. Instead of the President selecting the nominee with the help of Senate,in the Appeals court, it is expected that you meet the requirements, take an oath,pay the fee and submit an application.
